FMSCA pulls back on sleep apnea regulations for truck drivers

Truck accident lawyer says pull-back by the FMCSA will result in more preventable truck crashes

The Federal Motor Carrier Safety Administration (FMCSA) had recently proposed to toughen its standards for truck drivers who have sleep apnea. But sadly, it looks like it has now caved to pressure from the trucking industry and withdrawn the proposed regulatory guidance for obstructive sleep apnea, according to truckinginfo.com.

The FMCSA had originally proposed to adopt the recommendations of two advisory panels on sleep apnea guidelines. The recommendations advised the FMCSA to require medical examiners to evaluate truck drivers with a body mass index of 35 for sleep apnea.

Why it’s time to change Michigan’s excess economic loss law

I’ve been thinking a lot lately about how unfair Michigan’s economic loss law is for people seriously injured in car accidents. Our economic loss law as it applies to auto-negligence cases is broken, and it’s in need of repair from the Michigan Legislature.  Unfortunately, the Michigan Supreme Court is about to make the problem even worse.

Excess replacement services

Our economic loss law is about to become even more unfair. The Michigan Supreme Court will rule soon on whether seriously injured car and truck accident victims can claim and recover excess replacement services (help with services around the house) as part of an injured party’s excess economic loss claim.

Living in a big town like San Diego can be a worry, especially when you're on the road, horns grating and impatient folks needing to get to work or return home can occasionally be a blueprint for a screw up. Being concerned in a vehicle accident is a hideous experience without regard for heavy it is. The most important thing to recollect is to stay calm. I know that this is not as easy to do as to say in the heat of the instant, but remaining calm is the nicest thing that can be done. A whiplash injury can occur when the unexpected impact from the vehicle accident causes somebody's head to all of a sudden jerk forward then back, this is when whiplash injury can happen. Explain to your GP all the wounds you suffer from whether or not they're physical and not physical wounds. There are various degrees of whiplash injury agony and suffering.

Many of us can feel frightened driving for some period after an accident. The terms ‘acceleration / deceleration’ or ‘flexion / extension’ better explains the motion usually called ‘whiplash.’ The body is speeded up forward quicker than the auto is moving, leading to the head flopping backwards like that of a rag doll. There simply are no systematic studies, that support the insurance industry’s approach that ‘no property damage = no injury’ or ‘no claim=no pain’. In layman's terms auto damage doesn't compare to degree of injury. Neither are there any systematic studies, or statistics studies, that support the its accessory theory that ‘little property damage = tiny injury’ or ‘big property damage = enormous injury’. Obey all traffic symbols, and don't cross when a light indicates it's not your turn to do that. Even if you're crossing in an acceptable place, an auto accident can still happen if you don't see an automobile or if its driver doesn't see you, particularly if the junction doesn't have a traffic light. If an advancing car is close enough that you would need to run to clear its trail, you shouldn't cross.

Before crossing, look left, then right, then left again to test for traffic. If you sense the driver doesn't see you or doesn't propose to stop or slow down, get out of the way right away. Who else at the office will be working on my case? Five. How many cases like mine have you handled in the year? Four. How is payment for services handled? Are there any costs I've got to pay broke during my case or at the end? Six. If my case is lost and no compensation is awarded, will I continue to owe you something for your effort and time? ( In general, auto lawyers will charge for their services on a retainer fee basis, where the customer pays the solicitor thirty three p.c of what the lawyer collects in a settlement or if the case goes to trial. ) After the consultation is over, ask these questions : one. Did the auto accident solicitor listen well? Did the lawyer explain legal subjects to me in terms I was capable of understanding? Three.

Two People Rescued From Burning Car After Accident On Chicago’s Eisenhower Expressway (I290)

At that point, the car caught on fire. Media reports conflict as to whom – two Illinois State Police Troopers or the Fire Department – were able to extricate the driver and the passenger, a 50-year-old male.

Both the driver and passenger were taken to Loyola University Medical Center in Maywood.

Michigan drivers deserve the real story about  the Michigan Catastrophic Claims Association.

Especially when the insurance industry executives that make up the MCCA board are asking drivers to pay  the highest per vehicle assessment costs ever. But a straight story is hardly what Michigan drivers are getting when it comes to the MCCA.  In fact, the public can’t even look at the numbers.
